Interpretation and Definitions

Interpretation

The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

Definitions

For the purposes of this Disclaimer:

1. Company (referred to as either "the Company", "We", "Us" or "Our" in this Disclaimer) refers to Event Attendee Solutions, LLC, 116 North Washington Ave, Floor 3 Suite 3235, Scranton, PA 18503.
2. Crew Member means an individual whose name, nickname, or shift assignment is entered into a Schedule by an account holder.
3. Demo Schedule means a temporary, account-less Schedule created through Our demo feature and reachable only through a private link sent by email.
4. Schedule means a crew schedule document created and edited through the Service, including the crew names, assignments, and other information entered into it.
5. Service refers to the Website.
6. Share Link means the read-only public link that the Service can generate for a Schedule.
7. Website refers to CrewWith, accessible from https://crewwith.org.
8. You means the individual accessing the Service, or the company, or other legal entity on behalf of which such individual is accessing the Service, as applicable.

Disclaimer

The information contained on the Service is for general information purposes only. The Company assumes no responsibility for errors or omissions in the contents of the Service.

In no event shall the Company be liable for any special, direct, indirect, consequential, or incidental damages or any damages whatsoever, whether in an action of contract, negligence, or other tort, arising out of or in connection with the use of the Service or the contents of the Service. The Company reserves the right to make additions, deletions, or modifications to the contents of the Service at any time without prior notice.

The Company does not warrant that the Service is free of viruses or other harmful components.

The Service may contain links to external websites that are not provided or maintained by, or in any way affiliated with, the Company. Please note that the Company does not guarantee the accuracy, relevance, timeliness, or completeness of any information on these external websites.

Errors and Omissions Disclaimer

The information given by the Service is for general guidance on matters of interest only. Even if the Company takes every precaution to ensure that the content of the Service is both current and accurate, errors can occur. In addition, given the changing nature of laws, rules, and regulations, there may be delays, omissions, or inaccuracies in the information contained on the Service.

The Company is not responsible for any errors or omissions, or for the results obtained from the use of this information.

Fair Use Disclaimer

The Company may use copyrighted material which has not always been specifically authorized by the copyright owner. The Company is making such material available for criticism, comment, news reporting, teaching, scholarship, or research.

The Company believes this constitutes a "fair use" of any such copyrighted material as provided for in section 107 of the United States Copyright law.

If You wish to use copyrighted material from the Service for Your own purposes that go beyond fair use, You must obtain permission from the copyright owner.

Views Expressed Disclaimer

The Service may contain views and opinions which are those of the authors and do not necessarily reflect the official policy or position of any other author, agency, organization, employer, or company, including the Company.

Comments and content published by users are their sole responsibility and the users will take full responsibility, liability, and blame for any libel or litigation that results from something written in or as a direct result of something written in a comment. The Company reserves the right to delete any comment or content for any reason whatsoever.

No Responsibility Disclaimer

The information on the Service is provided with the understanding that the Company is not herein engaged in rendering legal, accounting, tax, employment, human resources, or other professional advice and services. As such, it should not be used as a substitute for consultation with professional accounting, tax, legal, employment, or other competent advisers.

In no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever arising out of or in connection with Your access to or use of the Service.

"Use at Your Own Risk" Disclaimer

All information in the Service is provided "as is", with no guarantee of completeness, accuracy, timeliness, or of the results obtained from the use of this information, and without warranty of any kind, express or implied.

The Company will not be liable to You or anyone else for any decision made or action taken in reliance on the information given by the Service, or for any consequential, special, or similar damages, even if advised of the possibility of such damages.

CrewWith Platform-Specific Disclaimers

CrewWith is a scheduling tool. It helps You lay out a crew schedule on a grid, set staffing targets, and share the result. The following disclaimers describe the limits of what that tool does and does not do.

Not a Compliance, Payroll, or Labor-Law Tool

The Service does not check, enforce, or advise on any legal requirement relating to work or volunteering. It does not evaluate maximum hours, required rest or meal breaks, overtime, minimum wage, minor work restrictions, union or collective bargaining rules, accessibility accommodations, insurance requirements, or any other employment, volunteer, or safety regulation in any jurisdiction. A Schedule that the Service accepts and displays without complaint may still be unlawful, unsafe, or in breach of Your own organization's policies. You are solely responsible for ensuring that any schedule You build complies with all applicable laws, regulations, contracts, and policies, and for consulting qualified professionals where appropriate.

Coverage Calculations Are Informational

The Service computes coverage by comparing the number of assigned crew in a time slot against the staffing target You entered for that slot. That calculation reflects only the numbers You supplied. It does not know whether Your targets are adequate, whether the crew You assigned will actually show up, whether they are qualified or trained for the task, or whether Your event is safely staffed. A slot shown as meeting its target is not a representation by the Company that Your event is adequately staffed, and You must not rely on it as one.

Share Links and Demo Links Are Not Authentication

A Share Link grants read-only access to a Schedule, and a demo link grants full edit access to a Demo Schedule. Both work for anyone who holds the link, with no account, no login, and no password. The links contain long random tokens and are not guessable, and We ask search engines not to index them, but possession of the link is the only thing controlling access. Anyone You send a link to can forward it to anyone else.

Treat these links as credentials. You are solely responsible for deciding who receives them and for any consequence of a link being forwarded, posted publicly, or otherwise disclosed. The Company cannot tell You who has opened a Share Link, and does not monitor how links are distributed.

Crew Information Is Your Responsibility

The Company does not verify the identity, availability, qualifications, background, or consent of any Crew Member named in a Schedule. Everything in a Schedule is entered by the account holder. You are responsible for the accuracy of that information, for having whatever permission is required to record it, and for the fact that everyone holding a Share Link to that Schedule can see it. We recommend using first names, nicknames, or handles rather than full legal names, and not entering sensitive personal information into a Schedule.

No Affiliation with Any Convention or Event

CrewWith is an independent product. It is not affiliated with, endorsed by, sponsored by, or officially connected to any convention, event, venue, or organization, including any convention whose name, schedule, or department structure You may enter into the Service. Any such names appear only because a user typed them, and their use does not imply any relationship with or approval by the organization named.

Service Availability and Your Own Records

The Company does not guarantee that the Service will be available, uninterrupted, or error-free, and does not guarantee that data will never be lost or corrupted. The Service depends on third-party providers for authentication, payment processing, and email delivery, and an outage at any of them may make the Service partly or wholly unavailable through no fault of the Company.

Conventions and events run to fixed dates that will not wait for a service outage. You should not rely on the Service as the only copy of a schedule You depend on. Export or otherwise record Your own copy of any Schedule that matters, and have a fallback for running Your event if the Service is unreachable when You need it.

Demo Schedules Are Temporary

A Demo Schedule is provided for evaluation only. It is limited in size, expires approximately seven (7) days after it is created, and is then deleted together with its contents. The Company makes no commitment to preserve, restore, or recover a Demo Schedule or anything entered into it. Do not use a Demo Schedule to run a real event.

Plans, Passes, and Read-Only Access

Editing a Schedule requires an active plan or pass. When a plan or pass ends, Your Schedules are not deleted: they and their Share Links remain viewable in read-only form until You purchase a new plan. Plan features, limits, durations, and prices are those presented at the time of purchase and are governed by the Terms of Use. Payments are processed by Stripe, and the Company does not store Your payment card details.

Age Restriction

The Service is intended for adults. You must be at least 18 years of age to create an account or use the Service. Individuals 17 years of age or younger may not use the Service.

Use of Your Information

Personal information is handled in accordance with Our Privacy Policy. Although We take reasonable measures to protect the information stored in the Service, We cannot guarantee the conduct of any person to whom You have given a Share Link or a demo link.
